1.- ORGANISER:
The company Iberostar Management, S.A.U. (hereinafter referred to as the “ORGANISER”), with its registered office at Calle General Riera, 154, 07010 Palma de Mallorca, Spain, Tax Identification Number (CIF) B-07.816.481, registered in the Mercantile Registry of Palma de Mallorca under registry number PM-25358, together with Iberostar Hoteles y Apartamentos, S.L.U (hereinafter “Grupo Iberostar”), with Tax Identification Number (CIF) B-28049344 and registered office at Calle General Riera, nº 154, 07010 Palma de Mallorca, Balearic Islands, Spain, is organising this promotion entitled “Iberostar Easter Egg Game”. Participation will take place via the Leads App (hereinafter referred to as the “APP”), as per the terms outlined in these legal terms and conditions (hereinafter the “PROMOTION”).
2.- ACCEPTANCE OF THE TERMS AND PURPOSE OF THE PROMOTION:
Acceptance of each and every one of the terms and conditions contained in this document (hereinafter referred to as the “Terms”) is an essential condition for participating in the PROMOTION. Participation in the PROMOTION implies unconditional acceptance of these Terms.
3.- PROMOTION DATES:
Participation in the PROMOTION will take place between 08:00 (GMT+1) on 03/30/2026 and 18:00 (GMT+1) on 04/06/2026.
IBEROSTAR reserves the right to modify these legal terms and the participation dates, either extending or shortening them, and to suspend the PROMOTION, with the sole obligation of communicating any such decision prior to the termination date.
4.- CONDITIONS FOR PARTICIPANTS IN THE PROMOTION:
Participation in the PROMOTION is free of charge and is open to all individual travel agents of legal age. Persons who do not meet these conditions are not eligible to participate in the PROMOTION and, if they do so, they will be disqualified.
Employees of IBEROSTAR, its group companies, suppliers, or entities involved in organising the PROMOTION, as well as their first-degree relatives by blood or marriage, are not eligible to participate. Should they participate, they will be disqualified and forfeit any prizes they might have won.
To participate and be eligible for the prizes in the PROMOTION, participants must confirm their full name, travel agency, professional email address, and play the game in the participation questionnaire through the iberostaragents.com website. When registering, participants must not provide fictitious information solely for the purpose of entering the PROMOTION, nor may they create multiple profiles to submit multiple entries.
5.- PARTICIPATION MECHANICS
Participants must register in the form that will be included in the website iberostaragents.com, providing their name, surname,, travel agency where they are employed, as well as a professional email address that must be verified through the verification link that you will receive in your email, otherwise the email address will not be added to the list. Participants must then play the game in the questionnaire about the Iberostar Hotels & Resorts, in accordance with the information provided on iberostaragents.com. Lastly, participants must accept the privacy policy and indicate whether they consent to receiving electronic commercial communications from the ORGANISER.
All participants who have complied with the aforementioned requirements during the promotional period specified above will automatically be entered into the awarding of the prizes, which will take place in accordance with the provisions set out in the following section seven.
6.- PRIZES
Drawing for one grand (1) prize, consisting of 10,000 star agent points The prize has a maximum value of $700 USD. This prize will be drawn among all participants in the AME region.
Prizes are not exchangeable for cash, nor may they be altered, modified, substituted, or transferred to third parties. Prizes will not be awarded to anyone other than the participating winner. IBEROSTAR reserves the right to substitute prizes with others of equivalent value. The prizes may remain unawarded without a winner if participants fail to meet the conditions and requirements to qualify as participants and winners of the PROMOTION.
Prizes are personal and NON-transferable.
7. SELECTION OF WINNERS
The winner will be selected randomly using Google's random number generator tool from among the participants who have played the memory game and matched all 4 pictures under 18 seconds by April 17th, 2026 or, in any case, within a maximum period of fifteen (15) days after the participation period has ended.
8. NOTIFICATION OF PRIZES TO WINNERS
Winner will be contacted via the email address provided on the participation form to inform them of their win and the conditions for redeeming the prize. Winner must accept the prize within five (5) calendar days of being notified.
If the provided personal data or email address is incorrect, the winner does not claim the prize within the specified period, cannot redeem the prize, is disqualified for violating the terms of this promotion, or does not accept the prize within the specified time, the winner will forfeit the prize, which will then remain unawarded.
IBEROSTAR may request information or documentation from winners to verify they meet the requirements to participate and win in the PROMOTION. This information will be requested via email, and the winner will have a period of five (5) calendar days from the date the email is sent to provide the required documentation. If the requested information or documentation is not provided to the satisfaction of the ORGANISER or it is determined that the participant does not meet the conditions, they will be disqualified.
9. PRIVACY POLICY APPLICABLE TO THE PROMOTION
In compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, which repeals Directive 95/46/EC (General Data Protection Regulation), as well as Organic Law 3/2018 of 5 December on Data Protection and Guarantee of Digital Rights (LOPDGDD), IBEROSTAR informs that participants’ data, as well as the data of the winners, will be processed automatically for the purpose of enabling participation in the Promotion and, where applicable, the allocation and enjoyment of the prizes associated with the “Iberostar Easter Egg Game” promotion.

Purpose of Processing:
The data will be processed by IBEROSTAR for managing and overseeing the promotion. Participants must consent to their data being processed and shared within the terms and conditions outlined in these rules.
If consent is provided, the data may also be processed by Iberostar Hoteles y Apartamentos, S.L.U. (hereinafter "Grupo Iberostar") for the purpose of sending commercial information via electronic or telephone means.
With the participant's consent, Grupo Iberostar may create a commercial profile based on their data to personalise services and provide tailored commercial offers. No automated decisions will be made based on these profiles. Personalisation of services implies participants' consent for hotels and associated companies within the group to access their user data, including the possibility of international data transfers. Recipients of Data: Winners' data may be published on Grupo Iberostar websites, social networks, media outlets, and other platforms deemed appropriate by Iberostar. The personal data of the winners required for the proper enjoyment of the prizes will be shared with the respective suppliers of said prizes. Personal data required for prize enjoyment will be shared with prize suppliers, which may involve international transfers outside the European Economic Area.
Legitimisation: The legal basis for data processing is participants' voluntary entry into the promotion and the corresponding legal relationship. Commercial communications are sent based on Grupo Iberostar's legitimate interest and participants' consent to receive electronic communications.
Retention Periods: Data will be retained for the duration necessary to manage the promotion and as legally required to address potential liabilities arising from processing. Data used for commercial purposes will be retained until deletion is requested.
Your Rights: You have the right to obtain confirmation as to whether or not we are processing your personal data and, if so, to access said data.
You may also request that your data be rectified if it is inaccurate or completed if it is incomplete, as well as request its erasure when, among other reasons, the data is no longer necessary for the purposes for which it was collected.
In certain circumstances, you may request the restriction of the processing of your data. In such cases, we will only process the affected data for the formulation, exercise, or defence of claims, or for the protection of the rights of others. Under certain conditions and for reasons related to your particular situation, you may also object to the processing of your data. In this case, we will cease processing the data, except for compelling legitimate grounds that override your interests, rights, and freedoms, or for the formulation, exercise, or defence of claims.
Similarly, and under certain conditions, you may request the portability of your data to be transferred to another data controller.
You can withdraw the consent you have provided for specific purposes, without affecting the lawfulness of the processing based on your consent before its withdrawal.

10.- OPERATION, COMMUNICATIONS AND IDENTIFICATION
In addition to the expressly indicated causes in these Terms, IBEROSTAR is not responsible for malfunctions and errors that may arise when participating in the PROMOTION, interruptions, deletion, or failure to record entries.
IBEROSTAR is not responsible for any consequences arising during the enjoyment of the prize, nor for any damages of any kind, personal, material, etc., either to the winner or to third parties.
IBEROSTAR will also not be held responsible if the prize winner fails to check their email address, does not access their account or social media profile, or if the email address provided is incorrect or incomplete, or if the address is not checked, has been deleted, or is configured in such a way that it classifies the messages or emails sent by IBEROSTAR as blocked or junk (spam), thereby restricting, deleting, or failing to download them.
IBEROSTAR may request any information or documentation from the winner to verify they meet the conditions to be a participant and winner in the PROMOTION. This information will be requested via email, and the winner will have a period of five (5) calendar days from the date the email is sent to provide the required documentation. If the winners fail to provide the requested information or documentation to IBEROSTAR’s satisfaction, or if it is found that they do not meet any of the conditions outlined in these Terms, they will be disqualified, and the prize will be considered void.
11.- TAXATION
The prizes in this promotion are subject to the provisions of Law 35/2006, of 28 November, on Personal Income Tax and the partial amendment of the Corporate Tax Law, the Non-Residents Income Tax Law, and the Wealth Tax Law. It is also subject to the provisions of Royal Decree 439/2007, of 30 March, which approves the current Personal Income Tax Regulations; Royal Decree 1776/2004, of 30 July, which approves the Non-Residents Income Tax Regulations; and Royal Legislative Decree 5/2004, of 5 March, which approves the consolidated text of the Non-Residents Income Tax Law and other related provisions issued for its development.
In accordance with the aforementioned regulations, participants in this promotion are informed that prizes awarded for participation in games, competitions, raffles, or random draws linked to the sale or promotion of goods or services are subject to withholding tax or advance payment on the income tax of individuals, provided the value of the prize exceeds €300. For clarification, Iberostar is obligated to make the corresponding withholding tax or income tax payment when the value of the prize exceeds €300 or any other amount according to the applicable regulations at the time. If the prize value is lower than this amount, Iberostar is not obligated to make withholding tax or income tax payments, although it will remain subject to formal information obligations to the Tax Agency.
Once the prize is accepted, it will generate a capital gain even if the winner does not enjoy the prize. The winner is solely responsible for their obligations to the Tax Authority. Iberostar, after the acceptance of the prize, is not responsible for whether or not the winner enjoys it, and it is released from any liability before any body, authority, or institution.
In relation to the above and in compliance with the current tax regulations, the promoter will make the corresponding tax withholding on the prize awarded and, at the appropriate time, will issue the relevant certificate to assist the participant/winner in fulfilling their tax obligations, as they will need to include the capital gain represented by the prize received in their income tax return, along with any other income they have earned. The total tax liability will allow for the deduction of the amount already withheld, as stated in the aforementioned certificate, in accordance with the provisions of Law 35/2006, of 28 November. Therefore, the promoter only assumes the legal obligation to carry out withholding when it is required by law, with the responsibility for fulfilling respective tax obligations resting with the taxpayer.
For tax purposes, it is notified that, in the case of prizes in kind, the basis for withholding will be the declared market value, increased by 20%, as set out in Article 105.1 of the aforementioned Royal Decree 439/2007, of 30 March, which approves the Personal Income Tax Regulations (IRPF). The withholding tax rate to be applied on the above-mentioned base will depend on the fiscal residency of the winner, which must be determined and, where applicable, verified at the time of prize acceptance. Accordingly, the withholding tax rate established by current legislation will be applied at the time of acceptance, which, as of the date of the publication of these Terms, is 19% for residents and for non-residents without a permanent establishment in the EU or EEA (Norway and Iceland) and 24% for other non-residents. Exceptionally, non-residents who prove their entitlement to a Double Taxation Treaty between Spain and their country of residence may be exempt from tax obligations in Spain. In such cases, the provisions of the relevant Treaty will apply.
Participants/winners will need to confirm their personal details on the day of their designation as a winner, showing their DNI (National Identity Document) or other valid identification document in Spain. In order for the aforementioned withholdings to be carried out, the winner must, in all cases, sign a written acknowledgement of receipt of the prize upon receiving it and provide the promoter with a copy of their DNI (National Identity Document) or another valid identification document recognised in Spain. Otherwise, they will lose their right to receive or enjoy the prize.
Completing the required personal and fiscal details for the delivery of the prizes is mandatory by law, and failure or refusal to provide such details will result in the loss of the right to the prize.
12.- RESPONSIBILITIES AND DISQUALIFICATION
IBEROSTAR reserves the right to disqualify any participants who act abusively or fraudulently, or any participant who falsifies, conceals, or misrepresents their participation details, or participates using different personal information or breaches any of the conditions in these Terms.
IBEROSTAR also reserves the right to verify the identity of participants to ensure they are not fictitious or created specifically to participate in the PROMOTION or to make multiple entries in promotions, and may, at its discretion, disqualify any participants suspected of engaging in such practices.
If IBEROSTAR or any associated companies involved in the PROMOTION suspect that a participant, or a third party, is altering any entry by any means, they will be disqualified, even if they have successfully participated or won a prize, without IBEROSTAR being required to notify the disqualification.
13.- GENERAL PROVISIONS
The resolution of any issues or disputes regarding the interpretation of these Terms will be the exclusive competence of IBEROSTAR.
IBEROSTAR reserves the right to modify the content of these Terms, as well as the prize, in order to facilitate the success of the competition and to promote the spirit of the contest. The Terms and any possible modifications will be permanently published on https://iberostaragents.com/es.
Furthermore, participating in a contest of this nature implies acceptance of the rules of the platform where it is held.

14.- LEGISLATION AND JURISDICTION
These Terms of the PROMOTION are governed by Spanish Law. Participants agree that any dispute arising from the interpretation or execution of these Terms will be expressly submitted to the jurisdiction of the Courts and Tribunals of Palma de Mallorca, waiving their own jurisdiction if applicable.
